Why should I include cover for building when I insure my apartment if the building is already insured by the community?
While the community insurance policy covers the building’s common areas and structure, it often leaves out important parts of your private property. These grey areas include:
- Air conditioning units

- Interior improvements made by the owner
In addition, this coverage ensures protection in case the community refuses to handle a claim that affects your apartment individually.
Example:
If your washing machine leaks and damages your parquet flooring as well as your downstairs neighbor’s ceiling, the community insurance will not cover this damage. That’s why it’s essential to have a private home insurance policy that includes both building and contents coverage.
Why is the building value in my policy lower than the amount estimated by a real estate agency, even though my apartment or house has a sea view?
Please note that the insured building value in your policy should reflect the reconstruction cost of the property, not its market or purchase value. It is based on an approximate estimate of the cost to rebuild the property using similar materials and construction standards.
Importantly, the value of the land or plot is not included in the reconstruction cost, as the land would still remain even in the event of a total loss.
In addition, features that increase the market value, such as sea views, location, or surrounding amenities, are not relevant for insurance purposes and are therefore not factored into the building sum insured.
Example: In the event of a fire, your property would need to be renovated: walls repainted, new floor tiles laid, windows replaced, and sanitary installations reinstalled. The insured sum must be sufficient to reconstruct and refurbish your property, not to purchase a new one.
Do I need to declare my alarm system in the home contents policy?
It depends on the insurance company and the total value of the contents insured.
In general, we recommend declaring as few protections as possible, since in the event of a claim, having declared protections (like an alarm) that were not active at the time of the incident can work against you and lead to a reduction or denial of compensation.
However, from a certain contents value threshold, insurers may require minimum protections, which often include a connected alarm system. In those cases, declaring the alarm becomes necessary to comply with the insurer’s underwriting conditions.
Can I insure my house even if the 'final de obra' is still outstanding?
Yes, in many cases it is possible to insure a property even if the final de obra (certificate of completion) has not yet been issued. However, insurers will typically require that the physical construction is fully completed and that the property is no longer considered a building site. Once the home is finished and you begin furnishing or occupying it, it’s important to switch from construction insurance to a standard home insurance policy to ensure continuous protection.
Can I insure my house if it is 'illegal' or does not have a 'cédula de habitabilidad'?
Generally, no—let us explain how this works:
When applying for home insurance, insurers typically do not ask directly whether the property is legal or has a habitation certificate (cédula de habitabilidad). However, in the general terms and conditions of most policies, it is clearly stated that properties without legal status or a valid cédula are excluded from coverage.
In practice:
- For minor claims, this usually doesn’t pose a problem, as loss adjusters (peritos) rarely verify the legal status of the property.
- But in the case of a major claim—especially one that would require rebuilding—the lack of legal status becomes a serious issue, as reconstruction of an illegal property is not permitted by law, and the insurer may deny the claim.

What is Decennial Insurance and when is it required?
Decennial Insurance (Seguro Decenal) is a policy that guarantees the structural integrity of a building for 10 years after completion. It is mandatory in Spain for residential buildings intended for sale.
Can I insure a renovation project?
Yes. Major renovations involving structural changes or extensions can be insured under an All-Risk Construction policy. Also smaller reforms can be insured if required.

How is the insured value of the building calculated?
The insured value is based on the reconstruction cost, not the market value. It includes the cost of rebuilding the structure using similar materials but excludes land value and location-based premiums like sea views.
Are private pipes and windows covered by the community policy?
There are generally two types of community insurance policies:
- One that includes private pipes and windows (privative elements)
- One that excludes them, covering only communal infrastructure
The choice depends on the community’s preferences and budget. Including privative elements offers broader protection but may increase the premium. It’s important to clarify this with the administrator or during the community meeting when selecting or renewing the policy.
What happens if there is no formal community constitution?
If a building does not have a legally constituted community, it cannot be insured under a community policy. In such cases, each owner must insure their share of the building individually, and claims must be filed separately by each owner
